Ward 5 City Council Candidate Jeffrey Kihien supports House GOP efforts to End Cashless Bail in Washington D.C.

–Last night, Congressional leaders from both parties passed a bill for the crime emergency in the District of Columbia, specifically looking to end cashless bail here in the nation's capital.
The effort to restore law and order was spearheaded by the White House Executive Order issued on August 25, 2025. The Order explicitly declares that D.C.'s pretrial release policies, which include prohibiting cash bail, have directly "contribute[d] to the disgraceful conditions" of the crime emergency. The Executive Order mandates that federal law enforcement and the Attorney General utilize all lawful measures to ensure the pretrial detention of dangerous suspects. Specifically, it requires federal agencies to pursue federal charges and detention for arrestees who pose a threat to public safety, and directs the Attorney General to assess D.C.'s policies to identify and request necessary modifications to end the cashless bail practice. The Order highlights that dangerous criminals are sometimes rapidly released, threatening American citizens, federal workers, and D.C. residents alike.
Reinforcing the Executive Order, Congress has introduced complementary legislation. Rep. Elise Stefanik (R-N.Y.) introduced the Ending Cashless Bail in Our Nation’s Capital Act to ban cashless bail in Washington, D.C. This bill ensures that violent offenders remain off the streets while awaiting trial. It specifically mandates that those charged with public safety or order offenses must pay cash bail instead of being released, amending the D.C. criminal code that has afforded judges wide discretion to release individuals charged with violent offenses, a loophole often used by "Far Left judges" to free repeat offenders.

– Last night, Congressional leaders from both parties passed a bill for the crime emergency in the District of Columbia, focusing on tightening pretrial release standards and restoring law enforcement capabilities.
The effort began with a major executive action on August 25, 2025, when the White House issued an Executive Order directly addressing the crisis. The Order declared that D.C.'s cashless bail and pretrial release policies "contribute to the disgraceful conditions" by allowing dangerous criminals to be rapidly released. The Order mandates that federal law enforcement and the Attorney General work to utilize the "fullest extent permissible under applicable law" to pursue federal charges and pretrial detention for suspects who threaten public safety, effectively challenging D.C.'s cashless bail policies.
Building on this push for greater accountability, the U.S. House of Representatives passed H.R. 5107, the Common-Sense Law Enforcement and Accountability Now in DC (CLEAN DC) Act. Introduced by Rep. Andrew Clyde (R-Ga.), the bill directly overturns large sections of the D.C. Council’s 2022 Comprehensive Policing and Justice Reform Amendment Act. The D.C. Council's legislation has been widely criticized by law enforcement leaders for banning proven police tactics, stripping legal protections for officers, and imposing restrictions that have demoralized the Metropolitan Police Department, fueling a retention and recruitment crisis. The CLEAN DC Act aims to restore "common sense policing" and faith in law enforcement's ability to execute their duties without fear of retribution.
